What People Say about Robert Garza !!!
“I know it’s hard for you,” he said. “It’s not easy. This is salvation. You can finally get on with your life.” As the lethal dose of pentobarbital began pouring into his arms, he took a few deep breaths and began to snore. In less than a minute, all movement stopped. He was pronounced dead 26 minutes later at 20:41 CDT.
Garza, who was a member of the Rio Grande Valley gang known as the Tri-City Bombers before his teens, insisted on a statement to police acknowledging his involvement in the September 2002 massacre in Hidalgo County. The shooting was made under duress and improperly obtained.
However, prosecutors said Garza orchestrated the gang’s plan to silence the women, who Garza believed had witnessed another gang crime, were looking to reach their trailer when several gang members opened fire on the women. Garza was present when the women working the bar in the room. “I really have nothing to do with what the state has come up with,” Garza told The Associated Press recently on death row. “I thought since we were gang members, they got me involved through the gang.
“I think they just wanted to close his case … they needed someone.” Evidence later emerged that the women had been killed accidentally. Another gang member never appeared in court because he accepted a plea deal and jail time.
Garza was arrested in late January 2003 and convicted under Texas political parties law, which makes non-triggers equally guilty. Hidalgo County Assistant District Attorney Joseph Orendan said there was evidence Garza was the gang leader, told his associates how to commit the murder, and was present when the shooting occurred. , accusing him, said this week.
In February, the U.S. Supreme Court declined to review his case. His lawyer, Don Vernay, said appeals have been exhausted. Garza filed his own appeal to the Supreme Court on Thursday, delaying his sentencing for about two hours before the judge could make a decision.
In his appeal, he argued that his trial attorney failed to obtain testimony from his mother, and that the jury should have heard testimony that he remained in the gang because he feared retaliation for quitting. He also claims that his trial court judge wrongly denied his request earlier this week to postpone the execution date.
Garza argued that the state should have assured him that the lethal dose of pentobarbital used to punish him was chemically active and legal. Texas prison officials say their stock of pentobarbital will expire this month. Texas prison officials said earlier Thursday they would continue to use the same drug, but declined to say how the state would replace its supply. “We have not changed our current enforcement agreement and have no immediate plans to do so,” Texas Justice Department spokesman Jason Clarke said in a statement to The Associated Press.
